Agreement - Terms and Conditions of Use
The Workers’ Compensation Administration Electronic Case Filing System (ECF)
is offered for the user’s (also referred to as “you” or “your”) use, conditioned
on your acceptance of the terms, conditions, and notices listed herein (collectively
the “Agreement”). Your use of ECF constitutes your agreement to all such terms,
conditions, and notices contained herein.
ACCOUNT REGISTRATION/UPDATES/SHARING OF INFORMATION
ACCOUNT REGISTRATION. You must register with the WCA in order to use ECF. You agree
to provide accurate and complete registration information.
ACCOUNT UPDATES. You agree to update your ECF account promptly if your e-mail address or
other registration information changes. It is your responsibility to maintain and monitor
your account’s e-mail address diligently for notices sent through ECF.
SHARING OF ACCOUNT INFORMATION. You are responsible for safeguarding your account information,
including your login and password. You agree not to share your ECF login and password with other
individuals, other than authorized support staff, for the purpose of e-filing and/or e- service.
Authorized support staff accessing the ECF using your ECF login and password must comply with all
terms of this Agreement and shall not share your login and password with other individuals.
CONFIDENTIALITY OF ACCOUNT INFORMATION/DOCUMENTS
ACCOUNT INFORMATION. Your ECF account information, including but not limited to your identity, username,
password, and designated e-mail address, shall not be made available to the public, unless so ordered by
the court, even if your identity and designated e-mail address are otherwise publicly accessible. Once
registered, your name and registered e-mail address will be available to other ECF users for the purposes
of e-service.
PUBLIC ACCESSIBILITY. Once accepted by the WCA court, documents e-filed through ECF may be publicly
accessible as part of the court file under §52-5-21 and NMAC 11.4.1.8.
USER ACCESS TO ACCOUNT/DOCUMENTS
ACCESS TO DOCUMENTS. You may access the documents you file electronically and the documents e-served upon
you through your ECF account for a period of time established by the WCA.
ACCESS TO ACCOUNT. The WCA reserves the right, in its sole discretion, to terminate or restrict access to
your ECF account and or its related services for good cause, including but not limited to violation of
applicable court rules or the improper or unauthorized use of your ECF account.
CONSENT TO ELECTRONIC SERVICE
By accepting this Agreement, you consent to electronic service through ECF for all workers’ compensation
court matters. You understand you are responsible for properly serving all necessary parties and participants
on your case, whether through ECF or another manner authorized by applicable court rules.
MODIFICATION OF THESE TERMS OF USE
The WCA reserves the right to change the terms, conditions, and notices under which ECF is offered at any time.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of ECF, you warrant to the WCA that you will not use ECF for any purpose that
is unlawful or prohibited by these terms, conditions, and notices, or by order of the court. You agree you will
use ECF only for legitimate, authorized purposes associated with e-filing and e-service on pending cases. You
will not use ECF in any manner that could damage, disable, overburden, or impair ECF, or interfere with any other
party’s use of ECF. You will not use ECF to obtain or attempt to obtain any materials, information, data or
documents through any means not intentionally made available or provided for through ECF. When using your ECF
account, you will submit pleadings only in cases in which you are an attorney of record or a party on the case.
Your account may be used only on cases where you are authorized to appear or participate.
LIABILITY DISCLAIMER
THE WCA MAY MAKE IMPROVEMENTS AND/OR CHANGES TO ECF AT ANY TIME OR TO THIS USER AGREEMENT AT ANY TIME. TO THE
MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE WCA BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE,
INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF ECF, WITH THE
DELAY OR INABILITY TO USE ECF OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY
INFORMATION, SERVICES AND RELATED DOCUMENTS OBTAINED THROUGH ECF, OR OTHERWISE ARISING OUT OF THE USE OF OR
OPERATION OF ECF.
